Terms of Service

By using WundertreOS or any Wundertre website, product, or service (the "Service") you agree to these Terms. If you don't agree, please don't use the Service.

1. Your account

You're responsible for everything that happens under your account. Keep your credentials safe and notify us immediately of any unauthorized use.

2. Acceptable use

Don't use the Service for unlawful activity, spam, abuse, or to infringe anyone's rights. SMS sending must comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, CTIA Messaging Principles and Best Practices, and 10DLC carrier requirements. Email must respect double opt-in. You are solely responsible for obtaining and documenting consent from your own contacts before sending them messages through the Service.

3. Wundertre SMS / text messaging program

Wundertre operates a U.S. 10DLC SMS program. The full program description, opt-in and opt-out instructions, message frequency, supported carriers, and other 10DLC-required disclosures are set out in our dedicated SMS Terms & Conditions, which are incorporated into these Terms by reference. By opting in to the program you agree to those SMS Terms in addition to these Terms of Service.

You are solely responsible for ensuring that any messages you send through the Service to your own contacts comply with the TCPA, CAN-SPAM, CTIA Messaging Principles and Best Practices, and 10DLC carrier requirements, including obtaining and documenting prior express written consent where required.

4. Billing

Paid plans are billed monthly through Stripe. You can cancel at any time; cancellation takes effect at the end of the current billing cycle. Usage allowances reset each Stripe billing cycle. Fees are non-refundable except where required by law.

5. Intellectual property

Wundertre and its licensors own all rights to the Service, including software, designs, and content we create. You retain ownership of the content you upload, and grant us a limited license to host and process it so we can deliver the Service.

6. Confidentiality and data protection

We treat your data as confidential and apply the safeguards described in our Privacy Policy. You agree to keep any non-public Wundertre information confidential.

7. Disclaimers

The Service is provided "as is" and "as available". We work hard to keep it reliable but make no guarantee of uninterrupted or error-free operation. To the maximum extent permitted by law, we disclaim all implied warranties.

8. Limitation of liability

To the maximum extent permitted by law, Wundertre's aggregate liability under these Terms will not exceed the amount you paid us in the twelve months before the claim arose. We are not liable for indirect, incidental, consequential, or punitive damages.

9. Indemnification

You agree to indemnify and hold Wundertre harmless from claims arising out of (a) your use of the Service, (b) your violation of these Terms, or (c) messages you send through the Service in violation of TCPA, CAN-SPAM, or carrier rules.

10. Termination

We may suspend or terminate your access if you breach these Terms or use the Service to violate applicable law. You may stop using the Service at any time.

11. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Disputes will be resolved exclusively in the state or federal courts located in Lubbock County, Texas.

12. Changes

We may update these Terms from time to time. We'll post the new version with an updated "Last updated" date, and material changes will be announced inside WundertreOS or by email.
